What is the Family Medical Leave Act (FMLA)?
The FMLA entitles eligible employees to take job protected leave for specified family and medical reasons with continuation of group health insurance coverage under the same terms and conditions as if the employee had not taken leave.
Who is Eligible for FMLA leave?
•Employers are generally subject to FMLA if they have 50 or more employees within a 75-mile radius, or are a public agency.
•Employees are generally eligible for FMLA leave if they worked for at least 12 months and have worked 1,250 hours within the last 12 months.
What the FMLA defines as a Year?
• The Calendar year
• Any fixed 12 month period such as your fiscal year
• 12 month period measured forward from the first date an employee takes FMLA leave
• “Rolling” 12-month period measured backwards from the date an employee takes FMLA leave
